Draft for legal reviewThese Terms are a starting draft and must be reviewed by counsel before publication. The defined terms, jurisdiction, and liability caps must be confirmed against Med Foresight's entity structure and insurance posture.
1 · Acceptance
By accessing or using med4sight.com (the “Site”) you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site. These Terms are a contract between you and Med Foresight (“Company,” “we,” or “us”), with its business address at PO Box 187, Issaquah, WA 98027.
2 · Marketing site vs. product
These Terms govern your use of the Site only. Use of the Patient Foresight Pro product (“PFP”) — including pilots, evaluations, and production deployments — is governed by a separate Master Services Agreement (MSA), an Order Form, and, where PHI is in scope, a Business Associate Agreement (BAA) executed between Med Foresight and the customer practice.
Nothing on the Site constitutes an offer or commitment to provide PFP. Pilot and production access is granted exclusively under signed agreements.
3 · Permitted use
You may use the Site to:
Learn about Med Foresight and PFP.
Request a demo or initiate a sales conversation.
Contact us through the channels listed.
You agree not to:
Reverse-engineer, scrape at scale, or attempt to derive the source code or models behind PFP from the Site.
Probe or test the security of the Site without prior written authorization.
Submit information that is unlawful, infringing, or that you do not have the right to share.
Submit Protected Health Information (PHI) through the Site. PHI must be processed exclusively within PFP under an executed BAA.
Use the Site to send unsolicited commercial messages or malware.
4 · No medical advice
Information on the Site is provided for general informational purposes only. It is not medical advice and must not be used to make clinical decisions. PFP itself is a clinical-intelligence assistant designed to support — not replace — independent professional judgment by a qualified clinician. Any clinical content shown in product screenshots, marketing materials, or demos is illustrative.
5 · Intellectual property
All content on the Site — text, graphics, logos, the Med Foresight and Patient Foresight Pro names, designs, and software — is owned by or licensed to Med Foresight and is protected by copyright, trademark, and other applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for the permitted purposes above.
6 · Feedback
If you send us suggestions, ideas, or feedback about the Site or PFP, you grant Med Foresight a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without obligation to you. We will not use feedback in a way that identifies you without your consent.
7 · Disclaimers
The Site is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. Med Foresight specifically disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components. Roadmap items, feature descriptions, and any forward-looking statements on the Site are subject to change without notice and do not form part of any contract.
8 · Limitation of liability
To the maximum extent permitted by law, Med Foresight and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site, even if advised of the possibility of such damages.
The above limits do not apply to liabilities that cannot be excluded under applicable law.
9 · Indemnification
You agree to indemnify and hold harmless Med Foresight, its affiliates, and their respective officers, directors, and employees from and against any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of applicable law, or your misuse of the Site.
10 · Third-party links
The Site may contain links to third-party sites. We do not control and are not responsible for the content, policies, or practices of those sites. Following a third-party link is at your own risk.
11 · Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including any violation of these Terms. Sections that by their nature survive termination — including IP, disclaimers, liability, indemnification, and governing-law provisions — will continue to apply.
12 · Governing law & venue
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws principles. Exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the Site lies in the state and federal courts located in King County, Washington, and you consent to that jurisdiction and venue.
13 · Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Your continued use of the Site after a revision constitutes acceptance of the revised Terms.
